Refund Policy

This Refund Policy explains when payments for MekaVerse NFT tokenization, NFT verification, metadata preparation, catalogue services and physical-to-digital integrations may be cancelled, refunded, credited or retained.

This Policy does not remove mandatory consumer rights. Where applicable law gives a consumer a cancellation, repeat-performance, price-reduction or refund right, that statutory right takes priority over any conflicting provision in this Policy.

1. Purpose and scope

This Policy applies to payments made directly to MekaVerse NFT for project-based Services, including:

  • utility NFT tokenization;
  • NFT verification and record review;
  • metadata architecture and preparation;
  • public verification-page preparation;
  • NFT catalogue or listing work;
  • QR, NFC, serial and physical-product integrations;
  • project documentation and related custom work.

The Policy operates together with the accepted quotation, Project Scope, NFT Service Agreement and Terms and Conditions.

Where a Project Document contains a specific refund term, that term applies to the Project only to the extent that it is lawful and does not remove mandatory consumer protections.

2. Definitions

“Business Client” means a person or organisation purchasing Services wholly or mainly for a trade, business, craft or professional purpose.

“Consumer” means an individual purchasing Services wholly or mainly outside their trade, business, craft or profession.

“Client” means either a Consumer or Business Client who orders a Service.

“Digital Content” means data produced and supplied in digital form, including downloadable files, digital reports and certain electronic deliverables.

“Project” means the custom work described in an accepted quotation, specification or order confirmation.

“Services” means project assessment, tokenization, verification, metadata, integration or other work supplied by MekaVerse NFT.

3. Business Clients and consumers

3.1 Consumers

Consumers may have statutory cancellation and remedy rights that apply independently of this Policy.

Nothing in this Policy excludes rights that cannot lawfully be excluded or restricted.

3.2 Business Clients

A Business Client does not receive consumer cancellation rights unless applicable law expressly provides otherwise.

Business Client refunds are determined by the accepted Project Documents, work completed, committed costs and this Policy.

3.3 Mixed-purpose purchases

Where a purchase has both personal and business purposes, its legal classification may depend on the main purpose of the transaction.

4. Consumer cancellation period

Where a qualifying Consumer enters into a distance contract for Services, the Consumer may generally have 14 days after the day the contract is entered into to cancel without giving a reason.

The cancellation request must clearly communicate the decision to cancel. The Consumer may use the official contact page or another written method accepted for the Project.

The cancellation right may be affected where:

  • the Consumer requests that performance begin during the cancellation period;
  • the Service has already been fully performed;
  • Digital Content has begun to be supplied with the required consent;
  • a statutory exception applies;
  • the contract is not a qualifying Consumer distance contract.

The 14-day period does not mean that all work completed during that period is automatically free of charge.

5. Starting Services early

A Consumer may ask MekaVerse NFT to begin work before the 14-day cancellation period has expired.

Where the Consumer makes an express request for early performance and later cancels within the cancellation period, MekaVerse NFT may charge a proportionate amount for the Services supplied before the cancellation notice was received.

The proportionate amount may reflect:

  • project assessment already completed;
  • research and verification work;
  • metadata already structured;
  • design, documentation or integration work completed;
  • approved milestones already delivered;
  • lawful third-party costs already incurred.

MekaVerse NFT should obtain the Consumer’s express request before beginning chargeable work during the cancellation period where legally required.

6. Completed Services

A Consumer’s statutory cancellation right for a Service may end after the Service has been fully performed where:

  • the Consumer expressly requested early performance;
  • the Consumer acknowledged that the cancellation right would be lost after full performance;
  • the Service was then fully performed.

A Business Client does not normally receive a change-of-mind refund after the agreed Services have been completed.

Completion does not prevent a Client from raising a genuine complaint about a Service that was not supplied with the required standard of care or did not conform to the agreement.

7. Digital content

Certain Project Deliverables may constitute Digital Content, including downloadable reports, metadata packages, digital certificates or other electronic files.

Where Digital Content is supplied immediately, the Consumer may be asked to:

  • expressly agree that supply may begin before the cancellation period ends;
  • acknowledge that the cancellation right will be lost once supply begins;
  • receive confirmation of that agreement.

Where the required consent or acknowledgement was not obtained, the Consumer’s statutory position may differ.

Nothing in this section removes statutory remedies for Digital Content that is defective, not as described or otherwise fails to meet applicable legal requirements.

8. Custom tokenization Projects

Most MekaVerse NFT Projects are individually configured for a specific Asset, Creator, token utility, metadata structure or physical integration.

Custom work may include:

  • reviewing Client-specific ownership and Asset information;
  • designing a unique metadata architecture;
  • preparing Asset hashes or identifiers;
  • creating token-specific documentation;
  • configuring a QR, NFC or serial integration;
  • preparing a public record for a specific NFT;
  • performing manual verification work.

For Business Clients, custom work already performed is normally non-refundable unless MekaVerse NFT agrees otherwise or materially fails to supply the agreed Service.

For Consumers, the custom nature of a Project does not by itself remove every statutory right. Any lawful deduction or refusal will depend on the type of contract, work completed, consent to early performance and applicable law.

9. Deposits and reservation fees

A Project may require an initial deposit, assessment payment or reservation fee before work or capacity is allocated.

The relevant quotation should explain whether the payment is:

  • credited against the total Project fee;
  • allocated to initial assessment work;
  • used to reserve production capacity;
  • partly or wholly non-refundable for a Business Client;
  • subject to statutory Consumer cancellation rights.

A payment described as non-refundable will only be retained to the extent that doing so is fair, proportionate, contractually disclosed and legally permitted.

MekaVerse NFT will not treat a label alone as overriding a mandatory Consumer refund right.

10. Milestone payments

A larger Project may be divided into milestones such as intake, verification design, metadata preparation, technical generation and final delivery.

Once a milestone has been completed and accepted, the payment allocated to that milestone is normally non-refundable for a Business Client.

Where a Project is cancelled before all milestones are complete, the refund calculation may distinguish between:

  • completed and accepted milestones;
  • partially completed work;
  • work not yet started;
  • external costs already committed;
  • unused payments held against future work.

Consumer rights continue to apply where the Client qualifies as a Consumer.

11. Blockchain and third-party fees

Blockchain transactions and third-party services may create costs that MekaVerse NFT cannot reverse or recover.

These costs may include:

  • network gas or transaction fees;
  • token deployment or minting costs;
  • decentralised storage charges;
  • NFC tag or physical identifier costs;
  • payment-processing charges that are not returned;
  • marketplace, hosting or infrastructure fees;
  • specialist third-party verification costs.

Once a blockchain transaction has been submitted and confirmed, the associated network fee is generally irreversible.

Third-party costs will not normally be refunded where they were properly incurred for the approved Project and cannot reasonably be recovered.

12. NFT catalogue transactions

A catalogue page may present information about an NFT, its declared utility, verification status and acquisition conditions.

The refund position for an NFT acquisition may depend on:

  • whether MekaVerse NFT is the seller or only provides information;
  • whether the transaction occurs through a third-party marketplace;
  • whether the buyer is a Consumer or Business Client;
  • whether Digital Content or a Service begins immediately;
  • whether the NFT includes a physical product or redemption right;
  • whether a blockchain transfer has already been completed;
  • the terms displayed for the specific NFT.

A completed blockchain transfer cannot necessarily be technically reversed, even where a separate monetary remedy may be legally due.

Third-party marketplace refunds are also governed by the marketplace’s own terms and procedures.

13. Client-requested cancellation

A Client may request cancellation through the official contact page or the communication channel being used for the Project.

The request should identify:

  • the Client’s name;
  • the relevant Project or invoice;
  • the date of the order;
  • the reason for cancellation, where the Client wishes to provide one;
  • the payment method used;
  • the requested resolution.

A Consumer exercising a statutory cancellation right does not need to provide a reason.

Work may continue until the cancellation request is received. The effective cancellation time is normally when the notice reaches the designated contact channel.

14. Cancellation by MekaVerse NFT

MekaVerse NFT may reject, suspend or cancel a Project where:

  • the Client provides unlawful or infringing materials;
  • ownership or Creator declarations appear materially misleading;
  • the requested utility is deceptive or prohibited;
  • the Client does not provide essential information;
  • required fees remain unpaid;
  • continuing would create material legal, technical or security risk;
  • the Client materially breaches the applicable agreement;
  • the Service becomes impossible to perform.

Where cancellation is caused by Client breach or prohibited materials, MekaVerse NFT may retain payment for completed work and unrecoverable costs.

Where MekaVerse NFT cancels for reasons not caused by the Client, unused prepaid fees for Services not supplied will normally be refunded.

15. Defective or incomplete Services

A Client should contact MekaVerse NFT promptly where a Service:

  • materially differs from the agreed Project Scope;
  • contains a material error caused by MekaVerse NFT;
  • has not been supplied with reasonable care and skill;
  • is incomplete without an agreed reason;
  • cannot perform an expressly agreed function.

Depending on the circumstances, an appropriate remedy may include:

  • correction of the affected Deliverable;
  • repeat performance of the relevant Service;
  • delivery of a missing agreed element;
  • a proportionate price reduction;
  • a partial or full refund where required or appropriate.

MekaVerse NFT should normally be given a reasonable opportunity to review and correct a remediable issue before a refund is demanded, except where applicable law provides otherwise.

16. Incorrect Client information

A refund may be reduced or refused where the problem results from:

  • an incorrect wallet address supplied by the Client;
  • incorrect Creator, owner or issuer information;
  • inaccurate token or contract references;
  • an incompatible network selected or approved by the Client;
  • missing third-party permissions;
  • incorrect physical-product identifiers;
  • Client approval of inaccurate public metadata;
  • failure to disclose a material ownership dispute.

MekaVerse NFT may offer corrective work under a revised scope, but blockchain and third-party costs may remain payable.

This section does not excuse an error independently caused by MekaVerse NFT.

17. Project delays

Estimated Project dates depend on Client cooperation, approvals, blockchain conditions and third-party availability.

A delay does not automatically create a refund right where it results from:

  • late Client materials or feedback;
  • scope changes;
  • delayed payment;
  • blockchain congestion;
  • third-party service outages;
  • ownership or compliance issues requiring review;
  • events outside reasonable control.

Where MekaVerse NFT materially misses a binding delivery date for reasons within its control, the parties may agree a revised date, reduced scope, service credit or refund of the affected unperformed work.

Mandatory Consumer remedies remain unaffected.

18. Refund calculation

Where a refund is due, it may be calculated using the following Project information:

Project element Typical treatment
Work not started Unused prepaid fees may be refundable, subject to lawful reservation or assessment charges.
Partially completed Services A proportionate amount may be retained for work properly supplied before cancellation.
Completed and accepted milestones Normally non-refundable for Business Clients, subject to defects and applicable law.
Recoverable third-party costs May be returned if MekaVerse NFT actually recovers them.
Irrecoverable blockchain costs Normally deducted where properly incurred for the approved Project.
Defective agreed Services May qualify for correction, repeat performance, price reduction or refund.
Unused future milestones Prepaid amounts may be refunded after permitted deductions.

Any deduction should be explained sufficiently for the Client to understand how the amount was calculated.

19. Refund method and timing

Approved refunds will normally be issued using the original payment method unless:

  • the original provider cannot process the refund;
  • the parties agree another lawful method;
  • identity or fraud checks are reasonably required;
  • a blockchain payment requires a separately verified return address.

Where a statutory Consumer cancellation refund is due, it will be processed without undue delay and within the time required by applicable law.

Other approved refunds will be processed within a reasonable administrative period after the amount and payment details have been confirmed.

Banks, card issuers, payment processors and blockchain networks may require additional time before funds appear.

A cryptocurrency refund may require a newly verified wallet address. MekaVerse NFT is not responsible for loss caused by an incorrect refund address supplied by the Client.

20. Chargebacks and payment disputes

Clients should contact MekaVerse NFT before initiating a chargeback so the Project, payment and requested remedy can be reviewed.

A chargeback must not be used fraudulently to retain completed custom Deliverables without paying for them.

Where a chargeback is opened, MekaVerse NFT may provide the payment provider with relevant records, including:

  • the accepted quotation or order confirmation;
  • proof of Client approval;
  • communications and delivery records;
  • completed Project milestones;
  • blockchain transaction records;
  • the applicable contractual terms.

MekaVerse NFT may suspend further work while an unresolved payment dispute remains open.

21. How to request a refund

A refund, cancellation or correction request should be submitted through:

The request should include:

  • the Client’s full name;
  • the Project or invoice reference;
  • the date and amount of payment;
  • the payment method;
  • a description of the requested resolution;
  • supporting information about an alleged defect or error;
  • the relevant wallet transaction hash where applicable.

A Consumer exercising a cancellation right may simply provide a clear statement that they wish to cancel the contract.

Do not send private keys, recovery phrases, passwords or authentication codes.

22. Complaints and escalation

If a Client disagrees with a refund decision, the Client may request a further review and provide additional supporting information.

MekaVerse NFT will consider:

  • the accepted Project Scope;
  • the Client’s legal status as a Consumer or Business Client;
  • the work completed and delivered;
  • applicable cancellation consent;
  • third-party costs already incurred;
  • evidence of a defect or contractual failure;
  • applicable mandatory legal rights.

A Consumer may also seek independent consumer advice or use another complaint or dispute-resolution route available under applicable law.

The parties should attempt to resolve a dispute through good-faith written communication before formal proceedings.

23. Policy changes

MekaVerse NFT may update this Policy to reflect changes in Services, payment methods, blockchain infrastructure, consumer-protection requirements or business practices.

The current version will be published on this page with an updated revision date.

Changes will not remove mandatory rights or retrospectively rewrite an accepted Project agreement where doing so would be unlawful.
